I may be missing something, but I think this trial is fraught with a lot more dangers than people seem to think. Supposing KSM steps up to the microphone and is read his (presumably detailed) confession. I only said that because they shoved my head underwater, he replies. The next witness steps up to testify. It's like the famous scene in Godfather Part II--once people are in public you can never predict entirely what they will say. Maybe that's the point.

Without thinking much about it, it seems to me that the best solution might be a civilian trial on a military base. Clearly, that jurisdictional balance can be arranged, no?

Yeah, pretty much the worst aspect of the attacks. I have gone to Europe twice since the recent failed attempt. Getting back into the US there are now full pat-downs plus full manual inspection of every carry-on bag for every passenger at the gate (this is in addition to the standard security at the airports). I personally now consider Business Class a necessity, rather than a luxury, on over-seas flights. Absent that, you are looking at a typical wait time of 3-4 hours for the security pass.

All this and they still let me (and most other passengers) take a bomb on to the plane (I hope TSA either never figures out or continues to ignore the threat a laptop battery represents).

To link this comment to your post ( ;) ), the BANANAs and TANTANAs are similar over-reactions to the terrorist "threat." In the case of the trials, I hope the Federal Government just stops asking for permission and holds the trials where ever it feels like holding them.
